1. General

This Disclaimer and User Agreement sets forth the terms and conditions of a license for you to use the International Federation of Red Cross and Red Crescent Societies’ (International Federation) Disaster Law database. By accessing and/or using the Disaster Law database, you agree to comply with all of the terms and conditions of this Disclaimer and User Agreement. From time to time, these terms and conditions may be modified and subsequent use of the Disaster Law database will imply consent to those changes as well. Accordingly, please continue to review this Disclaimer and User Agreement as posted on the Disaster Law database web site whenever accessing or using the Disaster Law database.

2. Nature of the Service

The Disaster Law database is provided as an information service only and does not constitute legal advice. While the International Federation will seek to continuously update the Disaster Law database, the information herein may not be entirely up-to-date or complete. This is particularly true with regard to the information and documents on national law which this database does not comprehensively cover.

3. Copyright and Proprietary Information

The Disaster Law database contains copyrighted material and/or other proprietary information that is protected by intellectual property agreements and copyright laws and regulations worldwide. Some of the documents provided herein are owned by persons or entities other than the International Federation and are used here by permission of the owners subject to the application of the limited license described in paragraph 4. The database structure, coding, and background information are the property of the International Federation as are all documents it has itself produced.

4. Limited Use License

You are hereby granted a non-transferable license to use, download and print the materials contained in the Disaster Law database solely for non-commercial purposes in accordance with the Fundamental Principles of the Red Cross and Red Crescent Movement and with this Disclaimer and User Agreement. You may not alter or remove any copyright symbol or other identification concerning authorship of any of the materials contained on or otherwise made available to you in the Disaster Law database. Except as may otherwise be expressly permitted, any redistribution or publication of any material contained on or otherwise made available to you on the Disaster Law database is strictly prohibited. Likewise, all forms of sub-licensing, reselling, republication or other forms of redistribution of any of the data or software used in the Disaster Law database, including Internet posting, electronic mailing, faxing, archiving in a public database, redistributing via a computer network or in printed form, to any third party, are strictly prohibited. The International Federation may deny you access to all or part of the Disaster Law database without notice if you engage in any conduct or activities that the International Federation believes violates any term of this Agreement.

5. No Implied Endorsement

The designations and search criteria used in the Disaster Law database do not imply the expression of any opinion on the part of the International Federation concerning the legal status of a territory or of any of the documents listed herein. The material or information in the Disaster Law database does not necessarily represent the official views or position of the International Federation.

6. Disclaimer of Warranty and Liability

NEITHER THE INTERNATIONAL FEDERATION EMPLOYEES, AGENTS, THIRD-PARTY CONTENT PROVIDERS, OR LICENSORS WARRANT THAT ACCESS TO AND USE OF THE DISASTER LAW DATABASE WILL BE FREE FROM INTERRUPTIONS OR FREE FROM ERRORS, NOR THAT ANY INFORMATION ACCESSIBLE FROM OR RELATED TO THE DATA IS FREE OF VIRUSES, WORMS, OR OTHER HARMFUL COMPONENTS. NO WARRANTY IS MADE AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE DISASTER LAW DATABASE, OR AS TO THE ACCURACY, RELIABILITY, OR CONTENT OF ANY INFORMATION OR SERVICE PROVIDED.

THE DISASTER LAW DATABASE IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MARCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL THE INTERNATIONAL FEDERATION BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY LOSS OF BUSINESS OR PROFITS, OR FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF ANY USE OF, OR INABILITY TO USE, THE DISASTER LAW DATABASE EVEN IF THE INTERNATIONAL FEDERATION IS PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY OTHER CLAIM BY YOU OR ANY OTHER PERSON.

You further expressly acknowledge and agree that information, text, graphics, and hyperlinks provided to you through the Disaster Law database and located on other sites throughout the combined global electronic networks known as the Internet and the World-Wide-Web are provided solely as a resource and a convenience to you. Such hyperlinks to other sites are not an endorsement by the International Federation of those sites. The International Federation makes no warranty, either express or implied, as to the accuracy, reliability, or content of such information, text, graphics, and hyperlinks.

7. Indemnification

You agree to defend, indemnify and hold the International Federation and its employees harmless from any and all damages, liabilities, costs and expenses, including attorneys' fees, related to any violation of this Agreement by you or any of your agents.

8. Federation Privileges and Immunities

Nothing in or relating to this Disclaimer and User Agreement shall be deemed a waiver of any of the privileges and immunities of the International Federation.

9. Arbitration and Governing Law

Any claims against the International Federation, its staff and volunteers, and its third party content providers and licensors concerning or arising from the use of the Disaster Law database shall be governed by general principles of law, to the exclusion of any single national system of law and shall be settled by arbitration in accordance with the United Nations Commission on International Trade Law (UNCITRAL) arbitration rules at present in force of which the Parties have taken due notice. The place of arbitration shall be Geneva, Switzerland. The arbitral award shall be final and any recourse to a tribunal excluded.

10. Miscellaneous

This Disclaimer and User Agreement constitutes the entire agreement and understanding between the International Federation and you with respect to the subject matter hereof. The provisions of this User Agreement shall inure to the benefit of the International Federation, its staff and volunteers, and its third-party content providers and licensors.
