UN International Law Commission – Draft Articles on the Protection of Persons in the Event of Disasters

The International Law Commission (ILC) is a UN body of legal experts elected by states to promote the “progressive development of international law and its codification.” In 2007, the ILC began work the on topic “Draft Articles on the Protection of Persons in the Event of Disasters” and appointed Eduardo Valencia-Ospina as Special Rapporteur.

The draft articles aim to “facilitate an adequate and effective response to disasters that meets the essential needs of the persons concerned, with full respect for their rights” (article 2). They address the various responsibilities and rights of the affected state responding to a disaster situation, as well as the duties and rights of the providers of international assistance. They also refer to the conditions to which assistance must be provided, for example, respecting humanitarian principles and human rights obligations.

In 2014, the ILC adopted its "first reading" of a full draft of the draft articles and accompanying commentary.  States and selected agencies were requested to provide written comments on them by 1 January 2016.  The IFRC's comments on the full draft are available here.
